DRAFT — legal review required. Prepared by the development team as input for a lawyer; not legal advice and not final until reviewed. The operator's details are placeholders. The Czech version prevails. Version 0.1-draft, 19 October 2026.
1. Who provides the service
"Bruchma Reservations" (the "service") is operated by {OPERATOR — company name, company ID, registered office} (the "operator"), contact {operator e-mail}.
The service is used by the business that opened an account (the "venue") through its users — the owner and staff.
2. What the service does
The venue can take bookings (a widget on its website, a booking page, manual entry), manage them, send guests confirmations and reminders by e-mail, and see overviews and statistics.
3. Free beta
During the beta the service is free of charge. The operator will tell the venue in advance if that is to change; charges never apply retroactively.
Beta means the service is still being developed: features may change, appear or disappear.
No service level agreement (SLA). The operator aims for continuous operation, backs the data up and has a disaster-recovery plan, but is not liable for outages or their length. We recommend printing the day's bookings before each service (the Print feature).
4. The venue's obligations
Use the service lawfully, in particular under the GDPR — the venue is the controller of its guests' personal data (see the data processing agreement).
Do not enter special categories of personal data (e.g. health data) — an "allergy" note should be only as detailed as the booking needs.
Protect access credentials; the owner must have two-step verification enabled.
Do not circumvent the service's technical limits (rate limits, abuse protection).
5. Personal data
The operator processes guests' personal data for the venue as a processor under the data processing agreement the venue accepts together with these terms. Account users' data is processed by the operator as controller under the privacy notice for users.
6. The venue's data and termination
The venue's data belongs to the venue. The venue may at any time ask for an export of its data and for the account to be closed; after closure the operator deletes or anonymises the data in line with the data processing agreement (backups expire at the latest when their retention ends).
The operator may suspend or close an account for a serious breach of these terms, with prior notice where the nature of the breach allows.
7. Liability
The service is provided "as is". The operator is not liable for lost profit or indirect damage (e.g. a booking not made during an outage).
The operator's total liability is limited to {amount — to be set by the lawyer}; this does not apply to damage caused intentionally or by gross negligence, or where the law does not allow a limitation.
8. Changes
The operator announces a new version in the application; the owner must accept it at the next sign-in. Without accepting it the service cannot be used further; the venue may close the account instead.
9. Governing law
These terms are governed by the law of the Czech Republic. Disputes go to the courts of the Czech Republic.
